Genuine Essiac™ Affiliate Program Terms

Welcome to the Genuine Essiac Team! Thanks for joining our Affiliate Program.

These Terms and Conditions apply to individuals who are accessing or using the Program both as a merchant (“we,” “us,” or “the Company”) and an affiliate (“you” or “Affiliate”) who refers customers to purchase products or services from the Company.

By participating in the Program, Affiliate agrees to use the Program in the manner specified in, and to be bound by, these Terms and Conditions. If you do not agree to these Terms and Conditions in their entirety, you are not authorized to register as an Affiliate or participate in the Program in any manner.

These Affiliate Terms and Conditions (“Affiliate Terms”) supplement and incorporate our General Terms and Conditions. By enrolling in or participating in the affiliate program, you agree to both these Affiliate Terms and our General Terms. If there is a conflict between the two, these Affiliate Terms will apply to your participation in the affiliate program.

1. Approve or Reject of the Registration

We reserve the right to approve or reject ANY Affiliate Program Registration in our sole and absolute discretion. You will have no legal recourse against us for the rejection of your Affiliate Program Registration.

2. Affiliate Links and Coupon

Your affiliate link is automatically generated, but you can also generate an affiliate link for a specific product or collection. If a website user clicks on someone else’s referral link and later clicks on yours, yours is the one that grants credit. In other words, the most recently clicked link receives credit for the sale.

An Affiliate may or may not be assigned a coupon code. If a coupon is assigned, details and permitted usage will be clarified in your Dashboard. If a customer both clicks on your affiliate link and uses a coupon code, you will not receive a double commission. If you are not assigned a branded coupon, then you are not allowed to promote any coupon.

You are free to promote Genuine Essiac via your custom link or your coupon code on the internet, with the exclusion of posting on our social media pages (@genuineessiac on Facebook, TikTok, and Instagram, as well as @essiactearemedy on X) or groups owned by us (Genuine Essiac Users Group on Facebook). Affiliate may advertise the merchant website on other online channels including but not limited to Facebook, Instagram, and TikTok, or offline channels including classified ads, magazines, and newspapers.

You may not use your link or coupon code to purchase Essiac tea for your own personal orders. If you are found to have done this, your account may be terminated without warning.

Your coupon code will not work when a customer opts for an autoship purchase because the product has already been maximally discounted. Please let your customers know.

3. Commissions and Payment

When you refer a customer who makes a one-time purchase on our website, you will earn a commission amount calculated based on the commission structure shown in your Dashboard. Commission amounts are based on order value and do not include extra fees (taxes, shipping costs, etc.).

To receive commissions, you must specify your payment details by navigating to Settings and entering your information. Payments are released within the first week of each calendar month. You will be paid once per month if you have earned a minimum of $75. Any funds earned but not paid out will carry over into the next month.

Payments will only be sent for transactions that have been successfully completed. Use of the Affiliate Program is subject to a fair use policy which gives the Company the right to review each and every referral order. Commission status is displayed in the Commission tab, and any paid commissions will be listed in the Payment tab. Transactions that result in chargebacks or refunds will not be paid out.

The only way we can pay you is via PayPal. We require a functioning PayPal account with an email address associated with that account to pay you. Unfortunately, our system cannot accommodate other forms of payment, and we do not issue free product or credits in lieu of payment. Any payments earned that are not associated with a valid PayPal account will be forfeited. Any payments that fail to exceed $75 will not be paid out if the Affiliate ceases promotional efforts.

PayPal will provide a tax form at the end of each calendar year if you have earned at least $600. This income may be taxable in accordance with the tax laws where you reside.

4. Marketing Tools

Affiliates may use images, files, and videos made available in the Marketing Tools section of the UpPromote affiliate portal.

These materials may not be altered or modified. However, affiliates may add platform features such as stickers, captions, or coupon codes when sharing the content on social media platforms (for example, Instagram Stories).

Affiliates may not use any Genuine Essiac brand materials, images, videos, or documents other than those provided in the Marketing Tools section of the affiliate portal unless prior written permission has been granted.

Affiliates must also follow the guidelines outlined in our Affiliate Content Guide.

If you require additional materials (for example, high-resolution images for printed banners or other promotional uses), you may submit a request by contacting us at support@genuineessiac.com. Approval must be received in writing before using any additional materials.

5. Network (if applicable)

If the Network tab is activated, an Affiliate can invite others to become their downline affiliate. If any downline affiliate brings an order to the merchant shop, the upline affiliate will also earn a network commission, based on merchant settings.

To invite other affiliates into the system, share your network link. Any person who clicks on that link and signs up will become a downline affiliate.

6. Cookies

We use cookies to track people who have clicked on your link. Customers must allow cookies for tracking to function.

If a person does not allow cookies or clears their cookies, we cannot track their activity and cannot pay commissions for that activity.

The cookie duration is 30 days and appears on the Affiliate registration form. The tracking period starts when a customer clicks on the Affiliate’s link or uses the coupon. Within the cookie period, every order made by that customer on the merchant website will automatically result in commissions to the Affiliate (there is no need for the customer to click the affiliate link again).

7. Existing Customer Orders

Affiliate commissions are intended to reward partners for introducing new customers to Genuine Essiac.

A new customer is defined as a person who has not previously placed an order with Genuine Essiac using any email address, account, payment method, or shipping address prior to the affiliate referral.

Orders placed by customers who have previously purchased from our store are not eligible for commission, even if the customer clicks an affiliate link before placing a new order.

If an existing Genuine Essiac customer places an order after clicking an affiliate link, the order may still be recorded in the system, but the commission will be declined or reversed.

Genuine Essiac reserves the right, in its sole discretion, to determine whether a customer qualifies as a new or existing customer based on internal order records.

8. Disclosure of Affiliate Relationship & Compliance

Affiliate agrees to clearly and conspicuously disclose their material connection to the Company in every communication, post, email, video, audio recording, or other content that includes an affiliate link, tracking link, tracking URL, or affiliate coupon code. Such disclosure must inform the audience that the Affiliate may receive compensation if a purchase is made using the link or code, and must be placed close to the promotional content so that it is easily noticed and understood by a reasonable consumer. Acceptable disclosure language includes, but is not limited to: “This post contains affiliate links. I may earn a commission if you use my link or code.”

Affiliate is solely responsible for ensuring that all promotional content and communications comply with all applicable laws, regulations, and guidelines, including the U.S. Federal Trade Commission’s endorsement and disclosure requirements. The Company does not undertake an obligation to monitor Affiliate content or communications, but reserves the right, in its sole discretion, to review promotional materials, request modifications, suspend or terminate Affiliate participation, and withhold, revoke, or deny payment of commissions attributable to non-compliant activity. The Company may, but is not required to, provide notice and an opportunity to cure any non-compliance.

Failure to comply with this section constitutes a material breach of this Agreement and may result in suspension or termination of Affiliate participation and forfeiture of unpaid commissions, including commissions generated during periods of non-compliance.

9. Prohibited Claims & Marketing Restrictions

No Medical or Disease Claims. Affiliate agrees that Genuine Essiac is sold as a traditional herbal tea and is not intended to diagnose, treat, cure, or prevent any disease.

Affiliate may not, directly or indirectly, make or imply any claim that Genuine Essiac:

  • Diagnoses, treats, cures, mitigates, or prevents any disease or medical condition
  • Is effective for cancer, tumors, autoimmune disorders, chronic illness, or any other specific disease
  • Replaces or substitutes for medical treatment
  • Has been clinically proven to treat or cure any medical condition
  • Produces guaranteed medical outcomes

This prohibition applies to all formats, including but not limited to:

  • Social media posts
  • Blogs and websites
  • Email marketing
  • Videos, livestreams, and webinars
  • Podcasts
  • Paid advertisements
  • Testimonials or personal stories framed as medical claims

No Implicit or Implied Disease Marketing

Affiliate may not:

  • Organize content by disease or diagnosis (e.g., “Essiac for Cancer,” “Essiac for Arthritis”)
  • Use hashtags referencing specific diseases (e.g., #cancertreatment, #stage4cancer)
  • Respond to disease inquiries by suggesting the tea has helped others with that condition
  • Share testimonials that present the product as curing or reversing a disease
  • Describe personal experiences as causing medical remission, tumor reduction, or disease reversal

Permitted Marketing Positioning

  • Describe Genuine Essiac as a traditional eight-herb tea
  • Share ingredient information as provided in official marketing materials
  • Discuss preparation instructions
  • Describe the tea as part of a general wellness routine
  • Share personal enjoyment of the tea without tying it to disease treatment
  • Use only claims consistent with materials in the Affiliate Marketing Tools section

Monitoring & Enforcement

The Company reserves the right, in its sole discretion, to:

  • Monitor affiliate promotional activity
  • Request removal or modification of non-compliant content
  • Suspend affiliate links
  • Withhold or revoke commissions generated through non-compliant marketing
  • Immediately terminate affiliate participation for material breach

Failure to comply with this section constitutes a material breach of this Agreement and may result in forfeiture of unpaid commissions.

Brand Bidding & Search Restrictions

Affiliates may not bid on, target, or attempt to rank for the “Genuine Essiac” brand name or variations of the brand name in search engines, paid advertisements, or search-engine-optimized content without prior written permission from the Company.

This includes, but is not limited to:

  • Google Ads or other paid search advertisements

  • Search engine optimization targeting the Genuine Essiac brand name

  • Pages designed to rank for searches such as “Genuine Essiac,” “buy Genuine Essiac,” or “Genuine Essiac coupon”

Indemnification

Affiliate agrees to indemnify and hold harmless the Company from any claims, damages, penalties, regulatory actions, or legal costs arising from Affiliate’s non-compliant marketing or unauthorized medical claims.

10. Removal from Referral Program

If an Affiliate wishes to be removed from the affiliate program, they can do so by contacting support@genuineessiac.com. We may choose to remove Affiliates from the program without warning, or terminate the program without notice.
